Speeding
If you’ve received a Speeding ticket, you have the option to contest it. As a former Police Officer and Police Radar Instructor, Whalen Legal Services will fiercely advocate on your behalf, once retained, to have the charge withdrawn or reduced to help protect your demerit points and insurance costs.
The process includes, once retained:
Requesting disclosure from the prosecutor (the case against you)
Reviewing the disclosure package and providing legal advice
Acting as your agent and/or legal counsel at Court proceedings, including Trial
Engaging in early resolution discussions
Penalties for a speeding offence can include:
Fine
Demerit Points
Suspension of Driver’s licence
Set fines for speeding:
1-19 km/h over the maximum speed limit – $2.50 per km
20-29 km/h over the maximum speed limit – $3.75 per km
30-49 km/h over the maximum speed limit – $6.00 per km
50 km/h or more over the maximum speed limit – No out of court settlement
Set fines for speeding in a Community Safety Zone:
1-19 km/h over the maximum speed limit – $5.00 per km
20-29 km/h over the maximum speed limit – $7.50 per km
30-39 km/h over the maximum speed limit – $12.00 per km
50 km/h or more over the maximum speed limit – No out of court settlement
Demerit Points for a speeding conviction:
3 points – exceeding speed limit by 16 to 29 km/h
4 points – exceeding speed limit by 30 to 49 km/h
6 points – exceeding speed limit by 50 km/h or more
As a driver with a full licence, if you have:
2 – 8 points, warning letter will be sent
9 – 14 points, second warning letter will be sent to encourage improved driving behaviour
15 + points, 30 day licence suspension
Novice Drivers face stiffer penalties for:
A combination of repeat violations of G1/G2/M1/M2 restrictions
Convictions for individual HTA offences carrying four or more demerit points
Court-ordered licence suspensions for HTA convictions that would have otherwise resulted in four or more demerit points
Escalating sanctions for Novice Drivers include:
30-day licence suspension for the first occurrence
90-day licence suspension for the second occurrence
